These Terms of Service govern your use of brookssundaraauthor.com and purchases made from Brooks Sundara Publishing, a Brooks Sundara LLC publishing brand.

Throughout these Terms, “we,” “us,” and “our” refer to Brooks Sundara Publishing. By visiting this website, placing an order, or purchasing a product, you agree to these Terms of Service, our Privacy Policy, Refund Policy, and any other policies displayed on this website.

1. ELIGIBILITY

By using this website, you confirm that you are at least the age of majority in your location or that you have permission from a parent or legal guardian.

You may not use this website or its products for any unlawful, fraudulent, or unauthorized purpose.

2. PRODUCTS AND AVAILABILITY

We sell books, ebooks, author merchandise, signed editions, print-on-demand products, and related items.

We make reasonable efforts to present product descriptions, images, formats, prices, and availability accurately. Colors and physical-product details may appear differently depending on your screen, manufacturing process, or print provider.

Products and availability may be changed, limited, or discontinued without notice. Placing an item in a shopping cart does not reserve that item.

3. DIGITAL PRODUCTS AND EBOOK LICENSES

Ebooks and other digital products are licensed—not sold—for the purchaser’s personal, noncommercial use.

Unless expressly authorized in writing, you may not:

Share or distribute a download link or ebook file
Upload the file to a public or shared platform
Resell, reproduce, copy, or commercially exploit the file
Remove copyright or ownership notices
Use the content to create unauthorized derivative products
Use the content for automated data extraction, machine-learning training, or artificial-intelligence model development

Purchasing an ebook does not transfer its copyright or intellectual-property rights.

4. BOOKFUNNEL DELIVERY

Eligible ebooks are delivered through BookFunnel.

After a successful purchase, BookFunnel sends a separate email containing a private download link and device-specific instructions. Customers are responsible for providing an accurate email address and checking Spam, Promotions, or similar folders.

Delivery services may occasionally be delayed by email providers, security filters, internet interruptions, maintenance, or circumstances beyond our reasonable control.

5. ORDERS

We reserve the right to refuse or cancel an order when reasonably necessary, including when:

Product or pricing information contains a material error
A product is unavailable
Fraud or unauthorized activity is suspected
The order violates these Terms or applicable law
Customer or delivery information is incomplete or inaccurate

If a paid order is canceled by us, the applicable purchase amount will be refunded to the original payment method.

6. PRICES, TAXES, AND PAYMENT

Prices are displayed in the currency shown at checkout and may change without notice. A price change does not affect an order that has already been completed.

Applicable taxes, shipping charges, and other required fees are displayed during checkout when available.

You agree to provide current, complete, and accurate purchase and account information. Payments are processed through Shopify and its authorized payment providers. We do not independently store complete payment-card information.

7. PHYSICAL PRODUCTS AND PRINT-ON-DEMAND ITEMS

Some physical products may be manufactured or fulfilled after an order is placed.

Minor variations in color, placement, texture, print alignment, or packaging may occur and do not necessarily constitute a defect. Estimated production and shipping times are not guaranteed delivery dates.

Customers are responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect or incomplete address may remain the customer’s responsibility where permitted by law.

8. SHIPPING

Physical-product shipping costs and available delivery methods are shown during checkout.

Delivery estimates are provided in good faith but can be affected by carrier delays, weather, customs processing, high-volume periods, and other circumstances outside our reasonable control.

International customers are responsible for any customs duties, import charges, or local fees not collected during checkout, unless applicable law requires otherwise.

9. RETURNS, REFUNDS, AND ORDER PROBLEMS

Returns and refunds are governed by our published Refund Policy.

Because ebooks and digital products are delivered immediately, digital purchases are generally final once delivery has begun. Exceptions may apply to duplicate purchases, incorrect or unusable files, unresolved delivery failures, or circumstances in which a refund is required by applicable law.

Nothing in these Terms limits consumer rights that cannot legally be waived.

10. INTELLECTUAL PROPERTY

All website content—including books, excerpts, stories, character names, series materials, artwork, cover designs, graphics, logos, photographs, videos, product descriptions, and branding—is owned by or licensed to Brooks Sundara Publishing unless otherwise stated.

This content is protected by applicable copyright, trademark, and intellectual-property laws. You may view the website and retain ordinary purchase records for personal use, but you may not reproduce, publish, distribute, modify, sell, or commercially exploit its content without written permission.

“Brooks Sundara,” “Brooks Sundara Publishing,” “The Diamond Witness,” and “Diamond Universe,” along with associated branding and creative materials, may not be used in a manner that falsely suggests authorization, endorsement, or affiliation.

11. REVIEWS AND USER-SUBMITTED CONTENT

If you submit a review, comment, photograph, testimonial, or other content, you confirm that:

You have the right to submit it
It is truthful and does not impersonate another person
It does not violate another party’s rights
It does not contain unlawful, abusive, malicious, or deceptive material

You grant us a nonexclusive, worldwide, royalty-free license to display, reproduce, and use submitted content in connection with our website and marketing, subject to applicable law.

15. DISCLAIMER OF WARRANTIES
